TERMS OF SERVICE

Welcome to the Terms of Service (these "Terms") for the websites includinghttps://www.superset.financeand any related subdomains (collectively, the "Website"), in each case operated by or on behalf of Superset Technologies Inc. ("Superset," "we," or "us").

The Website, the Superset Testnet (as defined below), and any content, tools, documentation, SDKs, features, or functionality offered on or through the Website are collectively referred to as the "Services."

These Terms govern your access to and use of the Services. By accessing and/or using the Services, you agree to be bound by these Terms. If you do not understand or agree to these Terms, do not use the Services.

For purposes of these Terms, "you" and "your" mean you as the user of the Services. If you use the Services on behalf of a company or other entity, then "you" includes both you and that entity, and you represent and warrant that (a) you are authorized to bind that entity to these Terms and (b) you agree to these Terms on the entity's behalf.

SECTION 8 CONTAINS AN ARBITRATION CLAUSE AND CLASS ACTION WAIVER. BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

1. Eligibility

You must be 18 years of age or older and not be a Prohibited Person to use the Services.

A "Prohibited Person" is any person or entity that is:

(a) the subject of sanctions administered by any governmental authority (including the U.S. Treasury Department's OFAC list, the U.K. or E.U. consolidated lists);
(b) located, resident, or organized in any jurisdiction subject to comprehensive sanctions; or
(c) owned or controlled by such persons.

By using the Services, you represent that you meet these requirements and will not use the Services for any illegal activity. Superset reserves the right to verify eligibility and deny or terminate access at its discretion.

2. The Testnet

2.1 Purpose and Participation

The Superset Testnet is designed to simulate liquidity provisioning, cross-chain transactions, and SDK interactions with the Superset Protocol for testing and research purposes. Transactions on the Testnet, including minting of any test assets, do not have legal effect and confer no rights.

Participation is voluntary. Superset makes no representation that the Testnet will replicate mainnet conditions.

2.2 Duration

Superset may modify, suspend, or terminate the Testnet at any time without notice. Any prior communications or public statements (including via Discord, Telegram, or blog posts) are non-binding and informational only.

2.3 Testnet Eligibility

To participate, you must:

Be 18 or older;
Not be a Prohibited Person;
Comply with applicable laws.

You agree not to:

(a) use VPNs or similar tools to circumvent geoblocks,
(b) use the Testnet for commercial purposes other than internal testing,
(c) exploit or attack the Testnet or any participant, or
(d) disrupt wallets, nodes, or data of other users.

Superset may request information (such as name, domicile, or wallet address) to confirm eligibility. Failure to comply may result in disqualification or forfeiture of any rewards.

2.4 Security and Wallets

You are responsible for managing your wallet credentials and private keys. Superset does not and will not access or store private keys. Any test assets sent to incorrect addresses are unrecoverable and entirely your responsibility.

2.5 Analytics and Data

By participating, you consent to Superset's monitoring of network activity, performance metrics, and usage data for research and product improvement. You grant Superset a perpetual, royalty-free license to use anonymized or aggregated data for analytics.

2.6 Public Visibility

Transactions broadcast to the Testnet are public and visible on-chain. Do not include confidential or personal information in any transaction or payload.

2.7 No Monetary Value

"Testnet tokens," "test liquidity," or any simulated rewards distributed on the Testnet are virtual items with no monetary or redemption value. They do not represent ownership, rights, or obligations in Superset or any mainnet deployment. Superset may modify, reset, or delete any such test assets without notice.

3. Right to Use the Services

3.1 License Grant

Superset grants you a limited, non-exclusive, non-transferable, revocable license to use the SDK, APIs, and documentation solely for internal evaluation and testing within the Testnet environment.

3.2 Restrictions

You may not:

Reverse engineer, decompile, or redistribute the SDK or related software;
Use automation, bots, or scripts to simulate usage;
Exploit vulnerabilities for personal gain;
Use the Services in violation of applicable law.

4. Intellectual Property

All rights, title, and interest in and to the Services, SDK, documentation, and associated content are owned by Superset or its licensors. You retain rights only in your own code and integrations. Feedback or suggestions you provide are automatically assigned to Superset without compensation.

5. Third-Party Services

The Services may reference or interact with third-party software (e.g., LayerZero, blockchain networks, or analytics tools). Superset is not responsible for their performance, security, or policies. Your use of third-party components is at your own risk and governed by their terms.

6. Privacy

Superset may collect minimal technical data for debugging, security, and analytics. No personal data is intentionally collected unless voluntarily provided (e.g., via email). For details, refer to the Superset Privacy Policy athttps://www.superset.finance/privacy.

7. Disclaimers, Limitations, and Risk Acknowledgement

7.1 Disclaimers

THE SERVICES AND TESTNET ARE PROVIDED "AS IS" AND "AS AVAILABLE." SUPERSET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Superset does not warrant that:

The Testnet will operate continuously or without errors;
Your use will be secure or free from loss, hacking, or delay;
Testnet data will remain available or accurate.

7.2 Limitation of Liability

To the maximum extent permitted by law, Superset's total liability to you shall not exceed $100 USD. Superset is not liable for indirect, incidental, consequential, or punitive damages, or for any data or asset loss.

7.3 Assumption of Risk

By using the Services, you acknowledge:

Testnets may fail or be exploited;
Cross-chain messaging may incur latency or reorgs;
Tokens and liquidity data may be lost or reset;
Third-party protocols (e.g., LayerZero) may malfunction.

8. Arbitration and Class Action Waiver

Any dispute arising from or relating to these Terms shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in Delaware, United States, in English, before one arbitrator.

You and Superset agree to waive any right to participate in a class action or jury trial.

9. Miscellaneous

Termination: Superset may suspend or terminate your access at any time for any reason.
Governing Law: Delaware law governs these Terms, without regard to conflicts of law.
Severability: If any provision is unenforceable, the remainder remains valid.
Force Majeure: Superset is not liable for failure to perform due to causes beyond its control.
Entire Agreement: These Terms constitute the full agreement between you and Superset.
